These Terms of Service ("Terms") govern your use of mobile applications, games, websites, and related services (collectively, "Services") published by Apex Trail LLC ("Apex Trail," "we," "us," or "our"). By downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Eligibility

Our Services are available to users of all ages. If you are under 13 (or the minimum age of digital consent in your jurisdiction), you must have permission from a parent or legal guardian to use our Services and make in-app purchases. By using our Services, you represent that you meet these requirements.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our Services for personal, non-commercial entertainment purposes, subject to these Terms. This license does not include the right to:

•Copy, modify, distribute, sell, lease, or sublicense any part of our Services

•Reverse-engineer, decompile, or disassemble our software

•Use our Services for any commercial purpose without written permission

•Remove or alter any proprietary notices or labels

3. Accounts

Some features require you to create an account or sign in via a third-party provider. You are responsible for:

•Maintaining the confidentiality of your account credentials

•All activity that occurs under your account

•Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. In-App Purchases and Virtual Items

Our Services may offer optional in-app purchases of virtual currency, items, or features ("Virtual Items"). By making a purchase, you acknowledge that:

•All purchases are processed by the platform store (Google Play or Apple App Store) and are subject to their terms and refund policies.

•Virtual Items have no real-world monetary value and cannot be exchanged, sold, or transferred outside our Services.

•We reserve the right to manage, regulate, modify, or remove Virtual Items at any time, with or without notice.

•Purchases are final except as required by applicable law or the platform's refund policy. See our Refund Policy for details.

5. User Conduct

You agree not to:

•Cheat, hack, exploit bugs, or use unauthorized third-party tools or automation

•Manipulate leaderboards, scores, or game systems

•Harass, abuse, threaten, or impersonate other users

•Transmit viruses, malware, or other harmful code

•Use our Services for any illegal or unauthorized purpose

•Interfere with or disrupt the operation of our Services

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account, removing content, and reporting illegal activity to law enforcement.

6. Intellectual Property

All content within our Services — including but not limited to software, graphics, audio, text, game mechanics, trademarks, and logos — is owned by Apex Trail LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
 

7. User-Generated Content

If our Services allow you to submit, post, or share content (e.g., usernames, profile information), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating our Services. You represent that you own or have the rights to any content you submit and that it does not violate any third party's rights.
 

8. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
 

9. Availability and Modifications

We may update, modify, suspend, or discontinue our Services (or any part thereof) at any time without prior notice. We do not guarantee uninterrupted or error-free access. We are not liable for any modification, suspension, or discontinuation of our Services.
 

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
 

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APEX TRAIL LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.
 

12. Indemnification

You agree to indemnify, defend, and hold harmless Apex Trail LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our Services, your violation of these Terms, or your violation of any third party's rights.
 

13. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination:

•Your license to use our Services ends immediately

•You lose access to your account and any associated Virtual Items

•Provisions that by their nature should survive termination will survive (including Sections 6, 10, 11, 12, and 14)
 

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State in which Apex Trail LLC is registered, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
 

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
 

16. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Apex Trail LLC regarding your use of our Services.
 

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
